107 Agricultural tenancy

For the purposes of the Agricultural Holdings Act 19861, a contract of tenancy relating to any land is a contract for an agricultural tenancy if, having regard to:

  1. 107.1

        the terms of the tenancy;

  2. 107.2

        the actual or contemplated use of the land at the time of the conclusion of the contract and subsequently; and

  3. 107.3

        any other relevant circumstances;

the whole of the land comprised in the contract (subject only to such exceptions as do not substantially affect the character of the tenancy) is let for use as agricultural land2.
