96 Pre-pitch agreements

Where an advertiser invites an agency to pitch for an account, it may require the agency to sign a pre-pitch agreement1. This may simply require that information supplied by the advertiser for the pitch be kept confidential. It may also contain provisions relating to ownership of pitch ideas and materials, or provisions for a ‘pitch fee’. Where the advertiser has very substantial bargaining power it may even contain a commitment on the part of the agency to certain contractual terms and conditions in the event that it is successful in its pitch.
