64 Rights in designs

64.1 Introduction

Rights in designs may become relevant in an advertising or marketing context, for instance where props or models are created for use in advertising, or where novel or distinctive packaging is created for a product.

In the United Kingdom, designs are protected principally by way of:

  1. 64.1.1

        copyright;

  2. 64.1.2

        two types of unregistered design right (United Kingdom and European Community); and

  3. 64.1.3

        two types of registered design right (United Kingdom and European Community).
