Complaints to the Advertising Standards Authority (‘ASA’) must be made in writing, and should normally be made within three months of the advertisement’s appearance. If a particular advertisement is found to contravene the British Code of Advertising, Sales Promotion and Direct Marketing (‘CAP Code’), the advertiser is asked to amend or withdraw it. Although the ASA does not itself have power to force a non-broadcast advertiser to comply with its requests, publicity is given to offending advertisements in the ASA’s regular reports, and sometimes advertisements are referred to other bodies for investigation1.
