50.2 Email marketing

The principal regulations covering marketing by email are contained in the Privacy and Electronic Communications (EC Directive) Regulations 20031, the Electronic Commerce (EC Directive) Regulations 20022 and the British Code of Advertising, Sales Promotion and Direct Marketing.

Some rules apply to all email sent for the purposes of direct marketing, whether solicited or unsolicited, and whether sent to ‘individual subscribers’ or ‘corporate subscribers’. The applicability of other provisions depends on which of these variables apply.
