50.1 General

The Electronic Commerce (EC Directive) Regulations 20021 implement Council Directive (EC) 2000/31 ‘on certain legal aspects of information society services, in particular electronic commerce, in the Internal Market’, which seeks to ensure the free movement of information society services within the European Union2 and applies, inter alia, to online commercial communications3.

The Regulations establish the principle that, although the United Kingdom can place restrictions on outbound communications, it cannot impose restrictions on inbound digital advertising from another member state unless the advertisement falls within one of the derogations or exceptions4.
