39 Estate agents and property developers

Under the Property Misdescriptions Act 1991, it is an offence for estate agents, builders of new property, renovators and developers of property, land developers and solicitors engaging in estate agency work to give a false or misleading statement about a property in the course of estate agency business or property development business1. A person who is guilty of an offence under the 1991 Act is liable on summary conviction to a fine not exceeding the statutory maximum, or, on conviction on indictment, to a fine2.
