35 Gambling Act 2005: prize competitions1

The Gambling Act 2005 provides2 that a prize competition or other arrangement under which a person may win a prize will not amount to gambling for the purposes of the Act unless it falls within the definitions of gaming3, lottery4 and/or betting5. As a result, any prize promotion which contains a requirement to exercise skill and judgment or to display knowledge that is reasonably likely to either:

  1. 35.1

        prevent a significant proportion of persons who participate in the arrangement of which the process forms part from receiving a prize, or
