1 General

The legal controls affecting the form, content and legal status of advertisements and other marketing materials consist of a wide variety of statutory and common law provisions. Many of the statutory controls are derived from legislation designed to protect the consumer and are concerned with the advertising of particular goods or services (for example, the Consumer Credit (Advertisements) Regulations 20041), while other areas of law have a wider application to advertising in general (for example copyright2 and passing off3).
