Watch the latest report on matters related to the practice areas of corporate and commercial, data security, employment, consumer, competition, bribery and corruption and financial services. This month’s highlights include:
Corporate & Commercial: Arnold v Britton and others UKSC 36
When a Court is asked to determine a contractual term that is in dispute, the Court will often need to decide whether it applies common sense or whether the words should take their literal meaning. The case of Arnold v Britton and others concerned a service charge clause in a lease for holiday chalets. Tune in from 00:48 to find out more.
Consumer: Consumer Rights Act
The Consumer Rights Act (CRA) will be in force from the 1st October. The Act consolidates and enhances existing consumer law, including unfair contractual terms. The Competition and Markets Authority (CMA) has now produced new guidance to assist businesses with understanding what makes terms and notices unfair. Tune in from 06:42 to find out more.
Bribery & Corruption: Modern Slavery Act
Last month we reported on the Modern Slavery Act. In particular, this Act places an obligation on certain commercial organisations to prepare a slavery and human trafficking statement each year. At the time of our bulletin last month the Government had not announced which organisations would be subject to this requirement but has now confirmed that it will apply to organisations with a turnover of £36m or more. Tune in from 08:44 to find out more.
