In August 2016, Lord Justice Briggs delivered a lecture to the Banking and Financial Services Law Association of Australia and New Zealand on the topic of common law courts’ ability to reduce legal uncertainty in the financial markets.

In this article based on his lecture, Lord Justice Briggs discusses the different types of legal certainty, the procedural helps and hindrances for a court seeking speedily to resolve legal uncertainties, and the recently introduced reforms to financial litigation procedure.
