New FPR 2010, Pt 38 on protection measures

As a little family law 'Christmas gift' changes regarding domestic abuse will come into effect, with relatively little notice, as from 11 January 2015, including the insertion of a new FPR 2010, Pt 38, to make provision in relation proceedings under Regulation (EU) No 606/2013 of the European Parliament and of the Council of 12th June 2013 on mutual recognition of protection measures in civil matters (the 'Protection Measures Regulation').

The key statutory instruments are:

  • The Civil Jurisdiction and Judgments (Protection Measures) Regulations 2014, SI 2014/3298—facilitating the application of the Protection Measures Regulation from 11th January 2015
  • Family Procedure (Amendment No. 4) Rules 2014, SI 2014/3296—amending (inter alia) the FPR 2010 to insert a new Pt 38
  • Family Court (Composition and Distribution of Business)(Amendment) Rules 2014, SI 2014/3297—amends the Family Court (Composition and Distribution of Business) Rules 2014, SI 2014/840 in relation to the allocation in the Family Court of certain proceedings on the mutual recognition of protection measures
  • The Civil Procedure (Amendment No. 8) Rules 2014, SI 2014/3299—amending Pt 74 of the Civil Procedure Rules 1998
