Increased court fees for issuing claims in force Monday 9 March

Parties should consider whether any impending claims can be issued this week to avoid the increase in court fees which looks likely to come into force this coming Monday, 9 March.

This follows the Law Society confirming that the Government plans to press ahead with its proposals for increased court fees and the changes are likely to come into force this Monday, having been approved by the House of Lords on 4 March.

Fees for cases above £10,000 in value will be 5% of the claim’s value (subject to a £10,000 cap) which will amount to a significant increase in court fees for higher value cases

What are the increases?

  • Claims of £10,000 or less are not affected
  • the issue fee for claims of a value between £10,000 and £200,000 will be 5% of the value of the claim (or 4.5% for proceedings in the County Court Business Centre and Money Claim Online users)
  • the issue fee for claims of a value in excess of £200,000 will be £10,000
  • the issue fee for money claims of an unspecified value will be £10,000
