Guideline hourly rate consultation

The Law Society has published an article calling for evidence for the Guideline hourly rates ​​(GHRs) ​​consultation being undertaken by a working group set up to conduct an evidence-based review of the basis and amount of the GHRs. 

The GHRs have not been updated since 2010. However, the courts continue to look to the GHRs when considering the costs even though they are increasingly out of touch with the hourly rates charged by solicitors​. Recent judgments have seen comment from judges that the fact the rates were fixed over ten years ago is unsatisfactory. 

The consultation comprises two parts: 

  • the collation of data from assessments undertaken between 1 April 2019 and 31 August 2020 and to obtain evidence, if available, of any agreement between legal professionals as to their hourly rate, whether or not an assessment was undertaken. The deadline to provide this information is 31 October 2020, and
  • obtaining information about costs assessments taking place between 1 September 2020 and 27 November 2020
