3 Mitchell decisions awaited from Court of Appeal

Whilst the eyes of the world might be elsewhere this week, litigation lawyers have theirs firmly fixed on the Court of Appeal. Much like buses, why wait for one decision when you can have three decisions at once?

The first, Denton v T H White, is being heard this morning followed by Utilise TDS v Davies and others and Decadent Vapours v Bevan and others, the outcomes of which should answer the questions of what is a ‘trivial’ breach of a court timetable, how courts should exercise their discretion in dealing with the issue, and what they should do if there was more than one ‘trivial’ breach.
