Private Finance Initiative contractors ‘part of public sector response’ to coronavirus (COVID-19)

The Infrastructure and Projects Authority, in conjunction with HM Treasury, has published guidance for Private Finance Initiative (PFI) contractors, telling them that they should consider themselves to be ‘part of the public sector response to the current coronavirus (COVID-19) emergency’.

The guidance, which is to be read alongside this Cabinet Office Procurement Policy Note, states that the coronavirus emergency is not to be regarded as an event of force majeur, and that PFI contracting counterparties should work together to ensure the continued delivery of public services.

Additionally, PFI contractors should make sure contingency plans are in place to enable continuity of full services in order to respond to the pandemic, and to maintain vital public services, notably the NHS. Contracting authorities have also been urged to work closely with PFI contractors to use all options available to them to maintain public services during the pandemic.
