MHCLG announces measures to help theatres bounce back after coronavirus (COVID-19)

The Secretary of State for the Ministry of Housing, Communities and Local Government (MHCLG), Robert Jenrick, has made a written ministerial statement in relation to preventing loss of cultural venues and planning conditions for holiday parks in England during coronavirus (COVID-19). The statement focused on two sectors: theatres, concert halls and live music performance venues and caravan and holiday parks. MHCLG has published further guidance on the statement.

In relation to preventing loss of theatres, concert halls and live music performance venues the Secretary of State announced that:

• with immediate effect, local planning authorities should consider current circumstances when determining whether to grant planning permission for a change of use or demolition of venues that have been made temporarily vacant by the effects of the coronavirus pandemic. The policy remains in place until 31 December 2022 unless otherwise stated

• the ministry seeks to amend the Town and Country Planning (General Permitted Development (England) Order 2015, SI 2015/596, to remove permitted development rights for demolition of theatres, concert halls and live music performance venues

In relation to caravan and holiday parks:

• while local planning authorities must follow their legal obligations, they should not undertake planning enforcement action which would ‘unnecessarily restrict the ability of caravan and holiday parks to extend their open season’

• where local planning authorities consider it appropriate to require caravan and holiday parks to make an application to vary relevant planning conditions they should prioritise the application and make an early decision to provide certainty to caravan and holiday park operators, having regard to the benefits to the local economy of longer opening season times
