CMA writes to holiday companies following consumer protection investigation

The Competition and Markets Authority (CMA) has written to ‘certain companies specialising in package holidays for groups’ as part of its ongoing investigation into suspected breaches of consumer protection law in the sector. The CMA has requested that the companies explain their views on when consumers should be offered a refund, noting that some businesses believe they are exempt from the Package Travel and Linked Travel Arrangements Regulations 2018, SI 2018/634 due to the organisation booking the package holiday not being a 'consumer'. The investigation follows a large number of package holidays being cancelled as a result of the ongoing coronavirus (COVID-19) pandemic.
