In this briefing, the LexisPSL Banking & Finance team look at two recent cases dealing with
misrepresentation and rescission.
The first, Raiffeisen Bank International AG v Asia Coal Energy Ventures
 EWHC 2602 (Comm), looks at misrepresentation in the context of a loan portfolio sale.
The second, SK Shipping Europe v Capital VLCC  EWHC 3448 (Comm), considers alleged
misrepresentations under a charter agreement. In both cases the courts considered such claims in
detail and provided a comprehensive guide to the issues, along with possible remedies, that parties
should bear in mind when dealing with claims of this nature. Guidance is also provided on how parties
should actually conduct themselves, irrespective of the documentation wording.
